You can use this pledge to understand what operational-continuity protection applies to your licensed MDriven software if fees change, an environment change prevents operation, or MDriven AB can no longer be reached.
Purpose and scope
MDriven AB (formerly CapableObjects RE AB) makes this pledge for all products and without stated product-specific exceptions. It is intended to reduce the operational risk of relying on MDriven software over time.
In this page:
- You means the user under an existing agreement.
- Provider means MDriven AB.
- Existing agreement means an agreement that is valid when the relevant protection level begins.
- Green Level fee means the fee applicable under normal operations before entry into Yellow Level.
This pledge applies immediately to all current agreements and to agreements entered on or after 2015-10-07.
Protection levels
The levels describe what happens as circumstances change. Green Level is normal operation. Yellow Level and Red Level provide progressively more control to you when normal provider operation cannot be maintained. Black Level addresses the situation where the legal owner cannot be reached because the business has been dissolved.

How the levels work in practice
Green Level: normal subscription or software assurance
Under Green Level, your existing agreement remains in normal operation and its fee has an annual increase limit of 6%.
For example, if you have a subscription or software-assurance agreement and Provider proposes a fee change exceeding the 6% annual limit, the agreement moves to Yellow Level rather than leaving you without a continuity option.
Yellow Level: operate the compiled software yourself
Yellow Level applies when a valid existing agreement is affected by a fee change that does not honor the Green Level limit. It is particularly relevant to subscription services such as Turnkey, but is not limited to Turnkey.
At Yellow Level, Provider no longer supplies CPU time or manpower. Instead, Provider provides the compiled software and instructions needed for you to run normal operations under your own control. The fee remains the Green Level fee, with a cap at the price when Yellow Level began.
For example, you can use the supplied compiled software and instructions to take responsibility for normal operation in your own environment. Yellow Level does not include future releases, defect corrections, or product improvements from Provider.
If changes in the operating environmentâsuch as operating system, database, Azure, or other component upgradesâmean that the supplied software no longer works in a similar manner to when Yellow Level began, and the situation cannot be resolved by a software upgrade, the pledge moves to Red Level.
Red Level: build and adapt from source
Red Level provides a source-code snapshot when a valid Green Level or Yellow Level agreement is affected by degradation or failure caused by environmental factors that cannot be fixed by a software upgrade.
You receive the source code needed to build and execute the service. Provider remains the legal owner of that code. You may modify the supplied branch in any way necessary to restore the service, but you may not publish or share it.
For example, if a required environmental component changes and the service cannot be made operational through a software upgrade, you can use the source snapshot to make the changes needed for continued operation. Your fee remains capped as specified for Yellow Level.
Black Level: release after verified dissolution
Black Level is available only when the legal owner of the source code is unreachable because the business has been dissolved, or when you conclude this after making your best efforts.
Before treating Black Level as active, contact Skatteverket and ask for the legal status and current owners of MDriven AB (organisation number 559151-1604). If Black Level applies, source code already in your possession is considered released under the BSD 2-Clause license model.
What this pledge does not provide
This pledge has explicit limits that you should account for in your continuity planning:
- Yellow Level does not require Provider to deliver new versions, bug fixes, or improvements.
- At Yellow Level, Provider does not provide CPU time or manpower.
- At Red Level, Provider retains ownership of the source code; you may modify the provided branch to restore operation, but may not publish or share it.
- Black Level concerns source code in your possession and requires the stated effort to verify the company's legal status.
- The pledge does not replace the terms of your individual agreement except where it expressly describes fee and continuity treatment.
Keep evidence and request the signed pledge
Keep your agreement, fee history, and any correspondence about a fee change or operational issue. These records establish the agreement and the point at which a protection level may apply.
